Oak Photo General Terms and Conditions
REFUND POLICY
If you are not 100% satisfied with your purchase on quality grounds or defect, you can return your order for a full refund up to 7 days after the date you received it. Simply contact the studio to inform us of the problem and if we can not make a replacement to satisfy your request we issue your full refund on return of the goods. Returned goods must be in the condition you received them.
We provide these photography Terms and Conditions to be as transparent to be clear, so there are no hidden unforeseen circumstances.
Event Photography and Shoot Deposits
It is agreed that the following Terms and Conditions set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties.
Booking Fee
The Booking fee secures the date, time and services of Oak Photo for the shoot or event it pertains to and is non-refundable or transferable in the event of cancellation by the the customer, it being the agreed loss suffered by the photographer due to cancellation. All cancellations must be in writing.
Payments
Following payment of the booking fee, balance of payment will be made clear prior to taking the deposit. No digital photographs, printed photographs or products will be delivered until all payments due have been paid in full. Payment for additional images is to be made when they are ordered.
Copyright
Any images or copies of images whether stored digitally or otherwise, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988 and remain the copyright of Oak Photo. It is contrary to the Act to copy or allow to be copied photographically, electronically or by any other means an image created as part of this contract without the permission of Oak Photo in writing.
License
Oak Photo shall be granted artistic license in relation to the poses photographed and the locations used. The Photographer’s judgement regarding the locations, poses and number of images taken shall be deemed correct. Due to the variables of the weather and the willingness of subjects it may not be possible to capture all the images requested.
Attendance
In the unlikely event of the assigned Photographer being unable to attend your event due to unforeseen circumstances, we reserve the right to appoint another photographer to attend your event on our behalf to undertake the photography to his / her best ability. They will be fully insured and competent to do so.
Limitation of Liability
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
Insurance
Oak Photo holds full business insurance for Public Liability and Professional Indemnity with Photoshield underwritten by LV (Liverpool Victoria) Insurance. Proof of this can be supplied on request along with proof of DBS checks.
